1. Introduction & Scope

Welcome to Mine Live Marketplace (the “Platform”), operated by Pixgen General Trading LLC (Abu Dhabi, United Arab Emirates). These Master Terms of Use (“Master Terms”) govern your general access to and use of our mobile application and our website located at mine.shop.

By accessing or using the Platform, you agree to be bound by these Master Terms and our Privacy Policy.

Legal Hierarchy & Specialized Terms

These Master Terms apply to all users (including guests). If you engage in transactions on the Platform, you are also subject to the following specialized agreements:

Buyer Terms & Conditions: Apply to all users who bid on or purchase items.
Seller Terms & Conditions: Apply to all verified legal entities or individuals who list and sell products.

In the event of a conflict between these Master Terms and the specialized terms above, the specialized terms shall prevail regarding transaction-specific matters.

2. Eligibility

To use Mine Live Marketplace, you must:

Be at least 18 years of age (or the applicable legal age in your jurisdiction to enter into binding contracts).
Have the legal capacity to enter into a binding agreement.
Not be prohibited from using our services under UAE laws or applicable international regulations.

3. Account Registration & Security

To access features like Bidding or Selling, you must create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the security and confidentiality of your login credentials.
Notify us immediately at [email protected] of any unauthorized use of your account.
Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. User Conduct & Community Standards

Mine Live Marketplace is built on mutual respect. When using the Platform, you agree not to:

Violate any applicable UAE laws or international regulations.
Post or transmit content that is unlawful, harmful, defamatory, obscene, or culturally insensitive.
Engage in fraudulent activity or misrepresent your identity.
Interfere with or disrupt the Platform’s servers or networks.
Attempt to gain unauthorized access to other user accounts.
Use automated bots, scrapers, or unauthorized means to access the Platform.
Harass, threaten, or intimidate other users, sellers, or our staff.

5. Intellectual Property

Platform Content

All branding, logos, designs, text, graphics, features, and software on the Platform are owned or licensed by Pixgen General Trading LLC and are protected by UAE and international intellectual property laws. You may not copy, modify, or distribute our content without express written permission.

User Content

You retain ownership of the content you post (such as chat messages or profile photos). However, by posting content, you grant Mine Live Marketplace a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content to provide and promote our services.

6. Disclaimers & Limitation of Liability

"As Is" Basis

The Platform is provided on an "as is" and "as available" basis. While we strive for excellence, we do not warrant that the Platform will be uninterrupted, secure, or error-free.

Marketplace Role

Mine Live Marketplace is a platform/intermediary that connects Buyers and Sellers. Except where explicitly stated in our Buyer Protection policies, we are not the direct seller of goods and are not responsible for the quality, safety, or legality of items listed by independent Sellers.

Limitation of Liability

To the maximum extent permitted by UAE law, Mine Live Marketplace and Pixgen General Trading LLC shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Termination

By You: You may close your account at any time via the app settings or by contacting support.
By Us: We may suspend or terminate your access to the Platform immediately if you breach these Terms, engage in fraudulent activity, or if required by law.

8. Dispute Resolution & Governing Law

Informal Resolution

Before formal action, you agree to contact us at [email protected] to attempt to resolve any issues amicably.

Governing Law

These Terms are governed by and construed in accordance with the laws of Abu Dhabi, United Arab Emirates.

Jurisdiction

Any disputes arising from these Terms that cannot be resolved through mediation shall be subject to the exclusive jurisdiction of the Courts of Abu Dhabi, UAE.

9. Updates to These Terms

We may update these Master Terms to reflect changes in our services or UAE regulations. Updated terms will be posted with a new "Last Updated" date. Continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.
