Welcome to Mine Shop ("we," "us," "our," or the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application and website located at mine.shop. By accessing or using Mine Shop, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use our Platform.

1. Eligibility

To use Mine Shop, you must:

Be at least 13 years of age (or the applicable legal age in your jurisdiction).
Have the legal capacity to enter into a binding agreement.
Not be prohibited from using our services under applicable laws.

By creating an account or using the Platform, you represent and warrant that you meet these eligibility requirements.

Post, transmit, or share content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
Engage in fraudulent activity, including misrepresenting product listings or payment information.
Interfere with or disrupt the Platform or its servers.
Attempt to gain unauthorized access to other user accounts or Platform systems.
Use automated bots, scrapers, or other unauthorized means to access the Platform.
Harass, threaten, or intimidate other users or sellers.

We reserve the right to remove content and suspend accounts that violate these conduct guidelines.

4. Live Shopping & Broadcasts

Mine Shop offers live shopping experiences where sellers can broadcast and sell products in real-time. By participating:

As a Viewer/Buyer:

You acknowledge that live streams may contain real-time errors or technical issues.
Product availability and pricing shown during broadcasts are subject to change.
Purchases made during live streams are binding and subject to our refund policy.

As a Seller/Broadcaster:

You are responsible for the accuracy of product descriptions and pricing.
You must comply with all applicable consumer protection laws in the UAE.
You grant Mine Shop a license to display, stream, and archive your broadcast content.
You agree not to broadcast prohibited or illegal content.

5. Purchases & Payments

Order Placement:

By placing an order, you make an offer to purchase the product(s) at the listed price.
Orders are confirmed once payment is successfully processed.
We reserve the right to cancel orders due to pricing errors, stock issues, or suspected fraud.

Payment Processing:

Payments are processed securely through third-party providers (e.g., Stripe).
We do not store your full payment card details on our servers.
You authorize us to charge the payment method provided for your order total.

Pricing:

All prices are displayed in UAE Dirhams (AED) unless otherwise stated.
Prices may be subject to change without notice.
Applicable taxes and shipping fees will be displayed at checkout.

6. Shipping & Delivery

Shipping options and estimated delivery times are provided at checkout.
Delivery times are estimates and not guaranteed.
Risk of loss and title for products pass to you upon delivery.
You are responsible for providing accurate shipping information.
Additional customs duties or import taxes may apply for international orders.

7. Returns & Refunds

Return Policy:

Return eligibility varies by seller and product type.
Items must be returned in their original condition with all packaging and tags.
Return requests must be initiated within the timeframe specified by the seller.

Refunds:

Approved refunds will be processed to the original payment method.
Refund processing times may vary depending on your financial institution.
Shipping costs may be non-refundable unless the return is due to our error.

8. Seller Terms

If you register as a seller on Mine Shop, you additionally agree to:

Complete our seller verification process, including business documentation.
Maintain accurate and truthful product listings.
Fulfill orders promptly and in accordance with your stated shipping terms.
Comply with all UAE consumer protection and e-commerce regulations.
Pay applicable platform fees and commissions as outlined in the Seller Agreement.
Handle customer inquiries and disputes professionally.

9. Intellectual Property

Platform Content:

Mine Shop and its content (logos, designs, text, graphics, software) are owned by Pixgen General Trading LLC and protected by intellectual property laws.
You may not copy, modify, distribute, or create derivative works without our written permission.

User Content:

You retain ownership of content you submit to the Platform.
By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our services.
You represent that you have all necessary rights to the content you post.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

The Platform will be uninterrupted, secure, or error-free.
Products sold by third-party sellers will meet your expectations.
Any defects will be corrected.

Mine Shop is a marketplace connecting buyers and sellers. We are not responsible for the quality, safety, or legality of items listed by sellers.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW:

Mine Shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not liable for actions or omissions of third-party sellers, payment processors, or delivery services.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mine Shop, Pixgen General Trading LLC, and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your violation of these Terms.
Your use of the Platform.
Your violation of any third-party rights.
Content you post or submit to the Platform.

13. Dispute Resolution

Informal Resolution:

Governing Law:

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates.

Jurisdiction:

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, UAE.

14. Termination

By You:

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

By Us:

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice.
Upon termination, your right to use the Platform ceases immediately.

Provisions that by their nature should survive termination shall survive (including ownership, warranty disclaimers, indemnity, and limitations of liability).

15. Changes to These Terms

We may update these Terms from time to time. When we do:

Material changes will be communicated via email or in-app notification.
Continued use of the Platform after changes constitutes acceptance of the updated Terms.
